Canadian Seed Seller Avoids Jail Sentence

CANNABIS CULTURE - A Montreal man who made millions selling marijuana seeds online has been spared a prison term by a Quebec judge.

When it comes to marijuana seeds, most Canadians are familiar with the case of Marc Emery, a well-known activist facing extradition and five years in a US prison for selling seeds online—but a lesser-known case involving a Canadian seed-seller named Richard Baghdadlian, one of the few cases in history where a Canadian has faced charges for selling marijuana seeds, has just wrapped up in a Quebec courtroom.

A judge sentenced the wealthy Montreal businessman to two years less a day to be served in the community.

According to the few press reports available about the trial, court evidence showed Baghdadlian's online pot seed company was doing "booming business". His company, Heaven's Stairway, made about 3.5 million dollars between 2000 and 2005, through popular websites like Overgrow.com.

The case has been playing out through the justice system since Baghdadlian's arrest in early 2006, nine months after the raid on Marc Emery's Direct seed business by the US DEA and the Vancouver police department. Crown prosecutors had asked the judge for a 5-year sentence for Baghdadlian, claiming he knew exactly what he was doing when he broke the law.

Baghdadlian pleaded guilty to charges of conspiracy to import and export marijuana seeds and inciting marijuana production.

But will Baghdadlian's light sentence have any bearing on Emery's case?

"It's certainly helpful in the fact that he didn't get a jail sentence," Emery told Cannabis Culture, "and yet he had half a million dollars cash on hand, gold bars, Harley-Davidson motorcycles and property that was seized by the crown. He didn't get any jail time; the judge ruled that there was no precedent for any more than a month in jail for a fairly large seed business, and that was the one example from British Columbia."

Emery was referring to the 2007 case of Daniel Anthony Kostantin, a BC man sentenced to 30 days in prison for selling marijuana seeds.

"I don't know whether it will affect my extradition," Emery said, "because in my case it is all political anyway, but it is certainly a helpful precedent to lend to the credibility of our argument that it is political.

Emery and his supporters say that the 2005 DEA raid on his business was an overtly political act, as evidenced by statements made at the time by DEA administrator Karen Tandy, calling Emery's arrest "a signficant blow not only to the marijuana trafficking trade in the U.S. and Canada, but also to the marijuana legalization movement."

"His marijuana trade and propagandist marijuana magazine have generated nearly $5 million a year in profits that bolstered his trafficking efforts, but those have gone up in smoke today," she said. "Hundreds of thousands of dollars of Emery's illicit profits are known to have been channeled to marijuana legalization groups active in the United States and Canda. Drug legalization lobbyists now have one less pot of money to rely on."

What a travesty of justice if Marc is extradited! How can any evidence, anywhere, show this to be something other than politically motivated!

There's a tremendous difference in the case of the Quebec seed seller. He wasn't selling seeds to U.S. residents. Big difference. That upped Marc's risk exponentially and I am sure he knew.

Stop blocking me, someone on her must not like me saying that the U.S. is corrupt. Look at all the corrupt organizations that run OUR country. I am only speaking the truth. We shouldn't extradite anyone from Canada to the U.S.

I think of all the starving people in the world and how easy it would be to grow crops of hemp for seeds to help feed them with the nutritional value of hemp seeds they could easily produce a strain that grows massive amounts of seed and end suffering but that makes too much sense.

As far as it goes If I was marc I wouldnt risk getting on another comercial arline again even a canadian one because even if he isnt extradited I wouldnt be surprised if he ever stepped on a plane someone would make sure it was re routed to the closest us airport. He would try to go to toronto from Vancouver and soon as it took off sent right to seattle that is my opinion, I think marc should really consider taking flying lessons and getting his own cessna or some other airplane that would make it quicker then busses or trains to any long destination. The govt of the world are so corrupt I am sure they would stoop this low or even try and pick him up on the street and bring him into the us black op style the sneaky bastages.

Basically if u make plenty of money and don’t rock the boat politically to end prohibition you get a slap on the wrist.This is great news for the Marijuana seeds sallers.

Let us not over look that

Let us not over look that our governments are, just like any other business or company, driven by profits. They where not able to take financial gains from Mr Emery's arrest, he has been donating the profits of his seed selling to the political groups fighting for the legalization movement. The other case, this man in Quebec, had purchased a big house, a nice bike, and had half a mil sitting around, he was keeping his personal profits. And he was not speaking out against the government. So by busting this man in Quebec, the government was able to take his possessions, and the income he had accumulated from the sales of seeds. They made their financial gain, and would be more than happy if he started gaining income again, in the same way so they would have another "pot of gold" to steal.
Marc was causing too much of a wide spread impact, he was willing to speak the truth, and put himself in the spotlight no one else wanted to risk taking. We need more people like him to step up, despite the personal risk and do everything we can to make the government realize that we will not be going away, we have been lied to by our government for long enough!
