The Federal Court has declined to throw out the case of an Ontario restaurant owner who wants one of his former patrons stripped of his right to smoke medical marijuana.

Ted Kindos, owner of Gator Ted's Tap and Grill in Burlington, Ont., is seeking a declaration from the Federal Court that people with a permit to smoke medicinal marijuana cannot do so in a public place or any licensed establishment.

Federal government lawyers will ask a judge today to throw out the case of an Ontario restaurant owner who wants one of his former patrons stripped of his right to smoke medical marijuana.

This is the latest manoeuvre in the legal battle between Ted Kindos, owner of Gator Ted's Tap and Grill in Burlington, and former customer Steve Gibson.

The restaurant owner is facing a human rights complaint for asking Mr. Gibson not to light up outside his business.

Minnesota Court Rules Bong Water Illegal

Bong water can count as a controlled substance, the Minnesota Supreme Court ruled Thursday in a decision that raises the threat of longer sentences for drug smokers who fail to dump the water out of their pipes.

In a 4-3 decision Thursday, the state's highest court said a person can be prosecuted for a first-degree drug crime for 25 grams or more of bong water that tests positive for a controlled substance.

B.C. Judge Agrees To Delay of Marc Emery U.S. Extradition Hearing

A judge has agreed to adjourn the extradition hearing for marijuana activist Marc Emery that was scheduled to begin next week.

Emery’s lawyer, Ian Donaldson, told B.C. Supreme Court Madam Justice Anne Mackenzie he needed more time to finalize an agreement with U.S. prosecutors that would end the need for the hearing.

Donaldson noted that two of Emery’s co-accused have pleaded guilty to their part in a scheme in which marijuana seeds were sold for use in grow-ops south of the border.
