"I Plead The Fifth"

On May 24 I testified during a Rhode Island Senate Judiciary Committee Hearing on S0270, the Marijuana Decriminalization bill.

I was the second-to-last witness, so most bases (talking points) were already covered, lots of impressive data and statistics were demonstrated in favor of decriminalization, and two out of nine witnesses were against it: a special assistant attorney general and member of the Barrington Substance Abuse Task Force.

So my testimony ended up being a lot more personal, because I was honestly coming from a personal perspective. I’ve been using marijuana responsibly for about 10 years now, and yet I graduated school with high honors, graduated college, got married, raised a family, hold a full time job, and volunteer in my community, have NO record – and right now, our laws say I should go to prison for that choice.

There was much debate and interrogation over drugged driving and how this was going to make our roads less safe. That we are putting innocent people on the roads at risk for sending the wrong ‘message’ that marijuana is not a criminal act. Drugged Driving laws exist; it’s a non-issue for this particular bill, yet it was the constant crutch, if you may, that the opponents and skeptics continually use as a detour to killing the bill. We had the MPP, DARE (Direct Action for Rights and Equality), R.I.C.C., an assistant professor of medicine at Brown University, all in support of marijuana decriminalization.

'Influencing the youth' was the other big talking point. If you decriminalize cannabis possession, what does that say to the youth? Drug use will increase, and more harm will be done. Marijuana is a gateway drug so surely making the penalties less severe for marijuana will actually end up causing youth to use even harder drugs just because of the perception that marijuana is ok. They said that marijuana-related rehabilitation rates have been on a steady rise for the past ten years. Decriminalizing marijuana will only increase these rates further.

No one seemed to want to focus on the fact that our laws regarding this relatively safe substance (deaths per year from marijuana: zero. Yearly alcohol related deaths: 105,000) are flawed to the core, and unless you outlaw tobacco and alcohol tomorrow, you’ll NEVER tell me I deserve to be in jail for this. That is why I am speaking out personally. We are still a democracy and we CAN still change bad laws, but boy, we sure do need some more Mamas and Grandmamas coming out to say to people like Senator Shibley “you want to put me in jail?! But you let the bars and clubs have parking lots?!”

Putting otherwise good, law-abiding, productive members of society in jail for choosing cannabis over alcohol, tobacco, over-eating, shopping, whatever the vice may be that you WON’T go to jail for – putting me, and every mother like me in prison is more harmful to our entire society than the act of inhaling.

I looked Senator Shibley, the most vocal opponent of this bill in the eyes, and I said, "Look at me and tell me I should go to jail." His answer was, "As to whether or not you should go to jail, I'm going to plead the fifth."

The bill died in committee.

As per influencing the children you couldn't have a weaker argument on their part. They've got the children so deeply under the influence of pharmaceuticals and institutionlized that they wouldn't know what sober is. Hardcore pharmaceuticals that strip them of all personality and even outright murder them or leave them cripped for life with a compounding slurry of permanent side effects.

The "wrong message" in their eyes is anyone telling them there's an alternative to that scourge they've been ramming down their throats. The "cherrishing the children" fallacy is simply an absurd argument comming from any realistic perspective, but it's these kinds of ultra predictable fear mongering arguments they attack it from because its' all they've got, so do be sure to have an answer for it.

I believe using your personal experiences was the right way to go.

You definitely gave Sen. Shibley something to think about and that he will remember the next time the issue of marijuana comes up.

Too bad the bill died in committee. But I'm hopeful in the next few years, the situation will turn extremely positive to finally end cannabis prohibition. It has too. It's what the growing majority of citizens want.

Harm Reduction

Well! I think you got "more balls than a bull in breeding season", shame on those people who don't have the same gumption you showed (hope that puts a smile on your face). It's very clear on the International scene and from history that Prohibition is coming to an end, 26 countries now take UN Drug Treaty options towards "Harm Reduction" because it provides societies with clearer, more rational approaches to protect children and young adults, who have rights but also need education about "responsible use". The United States continues to push for more of the same wrong policies of prohibition, which is pointless. It is only people like yourself who are willing to stand up and state the obvious that the world will change. It's time for the US to "eat some humble pie" and get over it.

A flawed premise..

Im sorry to say it but the whole premise of this argument is flawed. To the other side yes we do belong in jail for our choice to use cannabis. However they won't incriminate themselves by agreeing with an argument that irrelevantly appeals to emotions that vilifies their position.
Which brings up a separate point don't condemn our civil liberties because they were used to refute your position. We have these liberties for a reason.

can you conclude someone belongs in JAIL for growing and using a plant? How about the death penalty for speeding?

Death penalty for speeding

Death penalty for speeding would be more logical than a fine for cannabis –though extreme. When one steps in a car or any other vehicle (public or private) –you have just stated that your time is more precious than your life, your property or another’s life or property . . . if this wasn’t validated –you’d see only wrecks from vehicle error only . . . spinning legalization this way might allow us to influence a smart and caring politician, while understanding the underlying reason for driving: getting to point B faster, given it is dangerous to drive also means you place your time in front of any living creature in or near the vehicle . . . if its for an emergency only: death or life –then driving is not a subconscious statement about placing one’s time in front of human life.

The fifth amendment

I'm certainly not perfect, and I've never gone to law school nor studied politics. But until more people like me stand up and speak out to their congressmen, than how are our congressmen supposed to truley see and hear from the very people they are hurting by these flawed policies? My testimony made the news in two papers (which is big for Rhode Island haha) and it was because it was controversial and it was not something they were expecting to hear, and they weren't expecting to hear it from the "Soccer Mom".
And I have no problem w/ Shibley pleading the fifth whatsoever. As you said, we have that right for a reason. He is not exempt from excersing that right.
Senator Shibley actually wrote me an email the next day that thanked me for my testimony and he said that it takes courage and devotion to do what I did and that he could tell I had both. He also wished me and my family a happy Memorial Day. I don't think my congressmen are evil, I just think they need to hear a different point of view, and no one else in RI is willing to stand up and say "I use cannabis, and I'm not criminal" they need to see that we are gangs, mobsters, or cartels. Weed can only be illegal if we will actually outlaw any and everything potentially addictive like sugar, carbs, gambling, shopping, climbing a ladder –staying in a home, since that’s an accident friendly place. Don’t feel unsafe enough to let them read their own DEA and CIA fact sheets that proves that if cops keep drugs illegal –it causes a black market and that black market has terrorism written all over it and that would logically make a cop a terrorist sympathizer (regardless if they know). Tell them the truth: our lost wars since 01’ have cost us well over a trillion and if poor people cannot fight and oil being used for terrorism is bad for PR and publicity, then that proves its mostly (65%) about drugs . . . you should tell the politicians exactly where the wars are –I bet you your finest pen (I’m a writer –cannot have too many of those) that they have no idea were Morocco, Malawi, Iran, Afghanistan, Pakistan, Iraq, India, Cambodia, Thailand etc are on the map, because if they did –they’d understand that such developing nations with their cultures would in fact be the world’s number one have for drugs and not this Latin American crap we pretend has a lot of drugs, because it doesn’t in comparison.

Point the finger of Anti-American and soldier hater . . . let them prove that they don’t spit on us by keeping drugs illegal so we have to fight for them to lose more than just an economy. Remind them of Panama and the Iran-Contra and posit the notion that the only country to have ever used nukes in a war –won’t be so lucky as to not receive the same punishment –and it’s a gigantic increase in odds when you have State Sponsored Drug Rings in Iran and N. Korea negating the nuclear sanctions . . . give them a copy of the “9/11 Commission Report” that states Osama did try to buy weapons grade uranium (pdf pgs 60’s or 70’s) . . . it’s a fact they are working on a bomb with drug money as a FATWA state thing if it can be proven that our own CIA did or does the same thing (like they did in Nam too smuggling dope) . . . why shouldn’t our nation be the only nation that has Government drug dealers like the CIA. Not conspiracy theories, just agendas that have hands in other agendas for mutual strength as seen when Corporations will take over or fuse with another.

Remind them that a traitor by any other name is still a traitor and not even the rose has the right to such classification.

Legalization should also come with a Patriotic Right Hook –stick and move.

Too light on Congress

Most people with half a mind know that there is no addiction/health problems associated with cannabis. Either they choose to believe the propaganda, which Im afraid are too many, or they have a stake in it staying illegal.

If it's the first case, so be it.. There are too many simple minded in this world to try and enlighten them.

If it's the second case, and they have a stack in it remaining illegal. Then fuck them and their families. You are lucky to have never been caught. Imagine losing your kids, your livelihood and everything you own. Because you were caught growing a single plant in your house. And this is justified because these senators are giving money by the anti-legalization crowd.

I dont know if MMJ is legal in RI, but I'd expect a visit from the cops if it's not.

You cannot let these people off the cause. Check into Senator Shibley's record, is he recieving political donations from a police org, from prison entities? If so he's evil reincarnated. Accepting money to ruin other's lives..What would you call that?

Yes, RI does have a MMJ Program, whether it had one or not, I still would not be surprised to get a visit from the police, but I didn't allow that fear to keep me away from the microphone. I'm watching the NBA playlets and see the Iraq war vet being honored before a game. He's in a wheelchair, both of his legs are blown off below the knee, his left arm is gone at th elbow an his right is covered in scars and burns.

And for what? There's no way to stop another 9/11 if it happens it happens. Invading another country and killing a few Muslims not gonna stop shit. All your doing is creating more terrorists with the bomb gone astray blowing thir children and continuing this overlord mentality on their country.

I'm 24 years old. I would love to see my generation leading in the the charge giants this military complex. They use as dispensable pawns to get rich. Why should we serve them? Joining the military is quickly losing it's honorable status.

War is good for . . .

True that you cannot stop another 9/11, but drug money financed 80% of it and if it happens again, you must bring them to justice, but keeping drugs illegal creates a war when they are financed enough to keep us there long enough. A society that will rid the world of one less black market will be a bit safer and war might actually in the future involve to something along the lines of ousting a murderer . . . Saddam needed ousting, but we shouldn’t have ousted the infrastructure of the Government –just the Bathist. The problem with Muslim Militant terrorism is their yearning to rid Israel and the World Owes Israel as safe haven since you and I purposefully (by not 100% dropping out and living in the jungles etc) strove to live in the Greek and Roman world (Diaspora –war etc) that would displace the Jewish race and if I’m wrong –then we need to reincorporate slavery. It would be better if the FEDs removed the plank from their eye and its always good that the troops bring freedoms to the women of Islam (do you really think the majority really want 2nd class citizenship), though legalizing every drug from A-Z could mean an end or reduce corruption and oil (hempoline or a reduction at least) to the point that the wealth of these Saudi and UAE will humanize like Muslims in America and Europe . . . go ahead and let them wear a scarf around their head –but to make them sit in the back seat and to rape them because of your brother or because your husband found another woman is ridiculous. See the problem with the "War on Terror" is that there's no real enemy. You cant kill an idea. You kill one terrify and another step AI. His place. And for every year you spend occupying a contry you create 100 more terrorists fighting for their freedom.

I think the 18yr old was already brainwashed . . . we grew up knowing that killing people was bad in the form of what Stalin and Mao did (which justified our early premise of Vietnam, but did not justify the conclusion) and stopping Hitler and the rape of Nanking meant that war was good but only for that . . . the last time the U.S. military did something so horrible on a wide scale level was with the Native Americans and I hope we learned –I hope we learned to walk in their moccasins. The real brainwashing is when you buy something you cannot eat or live in or wear (I’m guilty too) and the only reason to get a job when one has the ability to farm, hunt or gather is so we can covet each other’s possessions in the form of so called earning a paycheck and buying and low and behold we are wanting cheaper prices at the cost of local jobs, which brings about slave labor where someone earns a dollar and must stretch it. That is war –war outside of mating rites and food reserves is war because the taxpayers (me too) want war by not destroying the number one thing that drives war, which is to want more and more . . . no greater war monger than one who’s food contained plastic packaging or who drives a car or who uses money . . . traditional hunting and farming doesn’t use money, so money isn’t a factor for daily survival if all would decide to go a day or two without food so the other tribe a hundred miles away can have some due to their flood or bad winter etc. All consumers using money are miniaturized war mongers whom haven’t the current ability to see past it and to change it with one flex of a National muscle that would stop it . . . we should take advantage of all the technology and knowledge that gold and war and spices and slaves and colonization taught us and all should be forced to live without stuff that one doesn’t make . . . maybe a utopian society based on ‘all for one and one for all’ kind of mindset –computers, which are from war would help contribute to medicine and food, while every human from leader like figure to soldier to teacher to plumber to dishwasher will work side by side obtaining food or building huts . . . imagine how much more land we could have if all decided to live with their parents and grandparents etc as seen in other cultures that don’t waste space on housing . . . but that won’t happen for a while . . . the possession of property is currently the worse sin we see since it does force others to be jealous or to work for that which they don’t need and that’s when you get people who decide to plant an American factory based on gains previously gotten from the Opium War or other such wars or consumer bought contracts. And currently volunteering for the armed forces 100% keeps everyone from having to face a draft . . . we’ve seen what cruel leaders do in Africa and Yemen and civilians are either too afraid or got themselves bamboozled to believe in money and power and position . . . the first sign of brainwashing is when you won’t refuse to pay the sales tax or other taxes knowing that such taxes goes to less than worthy programs like drug enforcement or a war for oil . . . its impossible to go to jail for refusing to pay taxes if 1million Americans decided to do it –what room –what space –what money to pay for your jail? I believe hemp will teach one to grow gasoline, concrete, wood, food, clothing, biodegradable plastics etc. No war starts first off with the civilian and that will take time to achieve if possible. What about a war against a nation that has consumerism and commercialism . . . nukes galore would justify the removal of the U.S. in the eyes of those with less –but what then? Will they do what we did and get greedy like the U.S.? Hemp at least can be a starting point –a small point and a point that won’t fix the problem –just minimize (harm reduction) . . . it is one bucket that can get the water out of the flooding village or it is better than just one bucket . . . but we will never know until we utilize hemp and realize that prohibition (given its not about slaves or forced prostitution or WMD’s) is wrong and costly and generates more harm than good.

But what about the kids . . . what message are we sending to the children –that to keep marijuana illegal will keep hemp out of our farms and factories and stores and gas stations so our American children can live as adults not going to work because of a higher unemployment rate due to no hemp and dirtier fuels like Natural Gas to plague their world’s.

I find it impossible that the high probability of a country that ushered the only nukes to another nation in war won’t receive the same treatment and keeping drugs illegal only begets the 1% GDP that makes it even more plausible that the alliance (AP article) between Iran and North Korea won’t have state sponsored drug programs like our own CIA Iran-Contra. What if little Johnny wants to go to war like his daddy –are we going to legalize drugs that negates the 65% of our current war on terror . . . doesn’t mommies precious angel deserve the right to become a crippled vet from an IED?

Yes in the 1940's and 50's,but very limited . . . you had maybe one amphetamine tablet for every 40-100 days and the Army Air Corp would have even more speed for your little bitty 12-30hr flying missions. The Nazis and Japanese tax payers supplied most of the world’s meth from the 30’s-45’. Speed was a defunct drug in the 60’s as evident in your rise in labs and biker gangs (HST’s Hell’s Angels), which made it even more popular. Logic would dictate that in order for you to make fun of the military because you disagree with me means you cannot be a tax payer and you cannot be a consumer of store bought food or petrol or wood –so I’m guessing you are a computer program since only a computer program can be blameless when not helping the big machine many pretend to despise with their taxes . . . all must refuse taxes or all must band together as best as we can and work as a team. True colores are good because they cannot fade out so easily. And yes -speed was used -but that's an Air Thing usually and its not something the military usualy gives out. I always get sad when I hear of anyone dying in this War -even the freedom fighters whom don't use anal sex or robbery etc to get their way . . . even in this war -we are fighting agaisnt real evil and if this isn't true, then I don't believe pot is illegal on the books -nor punishable. Did you hear about the Double Tour Marine shot 60-70 times in Arizona because some SWAT hole tripped during the raid causing his trigger finger to engage with the trigger, sparking up the adrenaline of all the other mongoloid SWAT to shoot . . . I was taught in WAR SWAT that your finger is the safety and never near the trigger between the trigger and the trigger guard. What kind of Piece of Shit non-trained cop would put his finger on the trigger . . . They don’t even do it right. You’re supposed to use a flash bang and non-lethal rounds. You’re supposed to do thigh to thigh and tight to tight lineup and not some jumbled mess they did when entering –this is proof our Police Academies are National Lampoon drinking and beach bunny areas. Pigs don’t even clean their guns –that’s how filthy they are. You’re always taught to do a warning shot before engaging just incase it’s not a real weapon. At least war zones have more of an excuse in such accidents . . . you never know if you walk on a pressure plate or have a young child offer you a teddy bear that blows him and you up. There are more accidents in Civilian cops than in the military. These pigs should go to war and see the drugs financing all the hype that keeps us there. But when you don’t get millions of tax payers refusing to pay their taxes –we are forced to go overseas . . . when the people in one great movement don’t storm the police stations and court houses and FED buildings as instructed so by the 2nd Amendment, we get prohibition and war and lies and brainwashed ideology. Sad the Marine’s 4yr old child had to see his father bleed to death . . . I guess that’s what they do because they are too pussy to go off to war and only imagine that war is blood and Glory when we all know it’s the opposite. And I feel sorry for all the Vets who join the police and engage in the same activity. At least the Military orders us out of fear of bad PR to disobey all orders that put our humanity in jeopardy because of a little Vietnam Village massacre and Prison scandal etc.

Seems like the opposing views of legalization is about the kids and road safety . . . SWAT shoots at kids and kills family members right in front of kids and forces the kids to know that fluffy was shot by the cops (who the fuck will shoot at your guard cat –oh, yeah, a Cop would?) . . . driving safety: too busy making a bust or searching or all the paper work for a busted user or all the time spent on the briefs keep the cops away from the road more than they should . . . if any would actually do their job, they’d be busy catching drivers for speeding and not analyzing: Suspect or Not in their one track minds. Searching a vehicle can take some time . . . waiting for a dog can take some time . . . waiting for a warrant can take some time. Then you’ve got the oinkers draining their bladder and going to the donut-shop after all that vehicle searching or home searching or waiting and watching for suspects and movements and who goes where and what kind. Kids have to worry about survival when a bread-provider is arrested and cannot support the child and family . . . is it a little ironic that increased incarcerations coincide to a national rate of increased divorces nation wide. Logic would dictated that the Department of Justice is anti-family because they arrest parents and children for drugs, thus separating families and their revenue and life giving jobs while protecting cigarettes (2nd hand murder), and a drink that can cause one to more likely engage in domestic, fights, infidelity (a typical marriage deal breaker) etc.

The dare program is responsible for any nugget of thrush to marijuana being a gateway drug. You tell kids that marijuana is as bad to their health as cocaine and heroin. When they try marijuana and realize that you lied to them, they have an no real info on the dangers of hard drugs.

The drugged driving belief is a joke. First off marijuana is a minuscule affect on driving. Drunk driving is the most horrific ordeal of the problems involving drugs. Yet alcohol remains legal.

I like your way of pushing mj legalization. "You wish to ruin my entire life, just because I choose a nonharmful personal way to enjoy my downtime" and why so you can keep these fat pigs with a badge and gun. Is this a personal thing against "hippies" or are you receiving money from anti legalization efforts. I suggest you throw on a pretty dress, throw your ass up in their air and take it like the whore you are.

The only way it can even make sense for them to say that people are automatically incapable of figuring out that marijuana is NOTHING like other drugs and yet for some reason we can have one drink and drive yet one spliff is apparently worse? Isn't that kind of against human rights to choose and control what does good for us? Any idiot can tell the difference between other drugs and marijuana..sheesh
