Sunday, February 12: The cruelties just pile up here at D. Ray James. Jodie just visited me and there’s a new rule: NO Holding Hands! Wow! After being able to hold hands during the entire visits at Sea-Tac FDC in Seattle, and during Jodie’s first five visits to DRJ, we could hold hands the entire visit. This new rule is very distressing and disappointing.

Marc with the books and documents he carries around every dayMarc with the books and documents he carries around every dayBut even worse, at 11:45am, with Jodie’s visit just under 3 hours of the 6 available hours, our visit and several others were terminated because the visitation room was over-crowded. There are 1,600 inmates here, with 1,000 more inmates to come, yet there are only tables for 27 inmates and their visitors! Other Federal prisons have visitation on Thursday, Friday, Saturday, and Sunday and Federal holidays, but here it is only Saturday and Sunday and Federal Holidays. [Note from Jodie Emery: As of March 3, visits are now allowed on Thursdays and Fridays. More news to come in future blogs.]

Most visitors of inmates here come several hundred to several thousand miles in order to see their loves one. Jodie has to come over 3,000 miles to get here. Now she can’t even hold my hands! This is also crushing for all the inmates who now have to sit up to 6 hours without any contact in these “contact visits”. The children will think there is something wrong or distant with their parents if they are unable to hold hands. This new rule of deprivation has no explanation because DRJ is one of the few prisons free of cell phones or illegal drugs, yet for the first 4 months, inmates have been holding their loved one’s hands on visitation day. [Note from Jodie: The explanation given later was that a couple was seen getting too close, so the warden instated the new rule to prevent any couples from touching at all. Inmates and family members are still requesting the rule be rescinded.]

Minimums and low security facilities for Americans have outdoor visitation areas, and even the warden’s instructions for visitation in the DRJ Policy & Procedure book indicate there is an outdoor visitation area expected here. Those inmates with just one visitor could double up with another at a shared table to alleviate overcrowding, certainly better than terminating their visit, you’d think.

Jodie also had to wait in the waiting area for 3 hours because her ride back to Jacksonville wasn’t returning to DRJ until 3:30pm, when visits end. Her cell phone, purse, and money couldn’t be brought into the building because DRJ doesn’t have any functioning lockers for visitors to put their property in. They are expected to leave it in the car they came in. This makes it impossible to come by taxi or be dropped off: where are you going to put your purse or cell phone? [Note from Jodie: The next visiting weekend, lockers were installed for visitors.]

Jodie left here very sad and distraught, crying for the 15 minutes prior to being taken away. I know right now, as I write this, she is fuming in the waiting area, no book or anything to read, and nothing to keep her occupied while killing three hours. It was a very sad Saturday on my birthday/Valentine’s Day weekend. No holding hands, just and omnipresent dread and repression during what is supposed to be the highlight of life here at D. Ray James.

Tomorrow is Sunday. Jodie will be visiting again, fortunately. I just hope she doesn’t say anything inflammatory and provocative to the staff for three hours. I’m unsure how to go about trying to rescind this new, inexplicable policy of no contact during a ‘contact’ visit, but I’ve thought of having affected families and spouses of inmates call the regional office of GEO Group, or even the warden here. I’ve put in a cop-out (complain form) to the warden regarding the no-contact policy, as well as one for the way too tiny visitation currently at one time; a federal prison of this size should have space to accommodate 3% to 10% of the total inmate population. That would mean 48 to 160 spaces for inmates and their guests/families.

I was reinstated officially to work in the law library. Dr. Davis’ first remarks to me were, “Did you have a subscription of National Geographic sent here under my name? Because one has started arriving and I just put it right in the garbage. Also, Mr. Emery, you can only work in the law library Monday to Friday, during the morning and afternoon. You cannot work in the law library in the evenings or weekends. And you can NOT do any legal work for inmates in your unit.”

I said I would come to the library in the evenings and work on my own projects. I said nothing about the remark about not helping inmates while in my unit, and you already know what I think of throwing out a magazine of impeccable quality like National Geographic.

Thursday, February 17th, 9:30pm:

Today I was eating the canned green beans at lunch when my left rear molar made a jarring ‘crunch’. I had chomped down on a rock, or stone – bigger than a pebble, anyway. The vibration of noise inside my mouth was a thunderclap and I thought I’d broken a tooth. I was eating carefully because inmates in the ‘chow hall’ had warned me that there was grit in the green beans, and 7 or 8 stones had been discovered, the hard way, while eating the green beans. The stone was the size of one of my molars. It’s not the first time either stones have been in the canned vegetables, although it’s a first for me. Yet another reason to be wary of the food here!

Despite my complaining, I am always looking for good news to report. I would love to have the problems at D. Ray James rectified. In fact, so would many of the C.O.’s that work here. They say it is more difficult a job when inmates are surly. It is 80+ degrees Fahrenheit (27+ degrees Celsius) in the hot blazing sun today, and air conditioning in “L” building broke down last night. It is going to be 9 months more of consistently hot and humid sun-burning days, and the staff and inmates are affected equally. So an aggravated inmate population does no one any good.

One of those frustrations for the law library staff was the difficulty in having an inmate named Thanongsack Phuangkeo get married to his fiancé Christine at the prison. He started his first request November 23rd, 2010 and after many delays, refusals, and confusions over responsibility for the procedure, Warden Booker put his approval in writing to Nang (as he is called) today! (See attachment A.) So once the Justice of the Peace is arranged, the first wedding at D. Ray James should happen in March sometime in the visitation room, so possibly Jodie and I will be witnesses.

By the way, if anyone is wondering, this marriage cannot save Nang from his ‘deportable alien’ status, but Laos does not have a repatriation agreement with the US, so it’s not immediately clear to me what happens to Nang after his sentence is up. Cuban, Vietnamese, Cambodian, Laotian, and some other nationals do not get deported to those countries because of a lack of diplomatic protocols relating to deportation and repatriation.

Economist Magazine YouGov pollEconomist Magazine YouGov pollPerhaps the best news I’ve received so far in jail was a YouGov poll in the February 12th edition of The Economist showing a MAJORITY of Americans in every age group and both Democratic and Republican voters want LEGALIZATION, taxation, and regulation of marijuana. So it is now a matter of WHEN, not IF – sooner rather than later. We have reached the point of obvious inevitability. So 2012 must be the year every US state with an initiative and referendum process gets a legalization/repeal of cannabis prohibition question on their state’s ballot.

Here’s what I said in my interview in High Times, due on newsstands in the coming months, to the question: “What is the most important thing for the cannabis community to concentrate on at this point?”

My answer is: “Legalization initiatives must be implemented in every US state where it can be done for the November 2012 vote. Not just California and Colorado and Washington, but Alaska, South Dakota, Oregon, Washington D.C., and ALL of the other states with an initiative and referendum process (check your US State here: http://www.iandrinstitute.org/statewide_i%26r.htm ). Eight or ten or 12 states with cannabis legalization on the ballot will create the synergy required to begin the last phase of our liberation: the repeal of cannabis prohibition in the House of Representatives, in the Senate and with the President.

“To begin your state initiative process to repeal your state laws on prohibiting personal possession and cultivation, you can join an existing campaign to gather signatures to put the legalization of cannabis on your state ballot, or organize the campaign yourself with others you recruit on Facebook, Twitter, and at rallies and community meetings. Don’t wait for the big donors or MPP or NORML to organize these initiatives. Individuals, right now, in mid-2011, should investigate the initiative process in their state, start a Facebook group, recruit and begin collecting email addresses of signature gathering volunteers. Take the language used by the Washington State activists at Sensible Washington that was used in their failed 2010 try, or their 2011 attempt, and then adapt it to your state.

“Contact me for advice! Just because I’m in prison is no reason not to pick my brain and experience. I have over 50,000 friends on our Facebook pages, the vast majority being Americans. I will direct those from your state to join you. I am available all day, every day, even behind bars to help, guide, inspire, mentor, assist, and advise on your initiative campaign. YOU CAN MAKE MARIJUANA HISTORY STARTING TODAY! You can make marijuana legal in your state by November 2012. Where your state has no initiative process, you CAN donate to, and go to, a state that does have it, and gather signatures with them. Every American must do their duty and their part in this historical final push. We have the numbers, we have the righteous cause, and we are – I speak of my fellow Americans – able to do this. You CAN make history! Never underestimate your power as an individual to change the world! I never did, and I did change the world in many ways that carry on today!

“The other important goal for Americans is to help Congressman Ron Paul get the Republican nomination for President 2012. Ron Paul is the cannabis culture’s greatest friend and ally in Congress and he has consistently spoken out against the drug war and cannabis prohibition. He has voted against the budget for the Drug Czar’s office, the budget for the DEA, every single time. Ron Paul has co-sponsored bills to legalize possession of marijuana, industrial hemp, truth in trials (so med users can testify about it in Federal Court), and many other repeal or reform bills regarding prisons, drug prohibition, policing and the unconstitutionality of federal drug control. He is a brilliant and wise man who, to me, is America’s greatest hero. Former New Mexico Governor, Gary Johnson, is a great man who is also seeking the Republican nomination. My ideal ticket for the 2012 election is Ron Paul for President with Gary Johnson as his Vice-President nominee.”

The most HT can print in their magazine is 4 or 5 pages, so I am hoping they put the entire interview online at HighTimes.com, which will be seen by many in addition to High Times’ substantial print circulation. I’d like to be on the cover of High Times; knowing that a great bud is always required on a cover that sells the magazine, a photo of Jodie and I in a massive cannabis hemp field, taken in the Prince Albert area of Saskatchewan in 2009 on the Farewell Tour, would be ideal, I think. Tell High Times you think so too.

Jodie was able to have a phone conversation with the regional director of GEO Group, a supervisor of this D. Ray James facility, in fact, on Friday, February 18th. This is hopeful in itself, that GEO Group is willing to listen. Jodie had left a message at the GEO regional headquarters, and got a call back the next day. She spoke to him about the recent decision to ban hand-holding during visitation and the overcrowding issue at the visitation area, and the GEO Group Regional Representative listened and took notes, so that is encouraging. He is apparently coming to D. Ray James in the next week ahead, Tuesday, February 22nd – Friday, February 25th. He will be discussing the matter of visitation protocols with the warden.

I too have encouraged inmates here to have their family call GEO Group or the warden at DRJCF to express, POLITELY, the rehabilitative effect of contact visits WITH CONTACT that are obviously acceptable at all other GEO Group Federal facilities. You can see that particular segment of the “The Jodie Emery Show: February 17”, as well as the follow-up show where she discusses her conversation with the GEO Group Regional representative. Jodie always knows the right approach to take. She is so wonderful a spokesperson. I learn a great deal from her patient style of communication. We make a great team together, and I can’t wait to be home!

    I’m a writer and this is what I do all day -if you worked at Taco Bell -would all those tacos mean you are obsessive and crazy. Hate to burst your bubble –but drug legalization has very little to do with people’s right to get high without legal interference. Violence is all the rage for what drug money can buy –plus street turf . . . thousands of dollars go a long way in Africa for someone’s agenda. If Hitler only jailed his Jewish offenders –would that be acceptable. Most weed isn’t Dro raised by some white boy or family –its Mexican or gang related –even the Mexicans got their hands on some Dro operations now. Its too nauseating when you’ve got thousands of pot-heads if not a million or more whom think drug legalization is about them getting high in their homes or friends house –buying it from some shop without the hassle of legal or the market being dry in some cases. Nope. Legalization is about stopping the bullets in Africa or Mexico or Compton . . . its about stopping the Bombs in India, Pakistan, Russia, Spain, Iraq, Afghanistan, Indonesia . . . its about stopping police brutality in lands where one gets executed for holding or Oklahoma being the number one state in the Union to house women offenders with its huge population of just over 3 million. Keeping the whole 25 with an L thing out of many 3rd time offenders of drugs. Keeping kids with families –stopping police from shooting dogs or unarmed homeowners –keeping the wrong houses from being served with guns drawn. Saving an economy and adding millions of jobs just from hemp and legal drugs –serving legal speed to keep houses from blowing up with children in them –not hearing the 9-1-1 tapes played on the news of a meth house going up in flames with the mother calling for help and spewing over the phone with tears in her mouth about her three children still in the house. Drive by shootings reduced. Criminals not using drugs as a means to do crime . . . keeping as many people out of temptation’s grasp of being in gangs or dealer units for the profit –reducing the word hood or ghetto in our vocabulary by taking out the organized crime element that kills, addicts and incarcerates both parent and child. Securing one’s right not to have a kind of organized bureaucracy that would send people to jail for worship or having bibles –since cops are well trained in the right of jailing and reducing freedom and opportunity to those not engaged in the acts of violence, destruction or theft. Besides, writing all this only takes a little bit of time: I’ve already done the chores, walked the dog –what else to do but get high and have sex later on –then read the paper and some Camus . . . live off my job -educate pepole like you about drug legalization -inspire you to travel to the hood in Iraq or Mexico to see up close drug money doing bad things.

    Sounds like this redneck spent alot of his time in prison in the showers. Nothing Marc talks about sounds like crying. He is just accustomed to common sense and decency. Anyone of us would find the evils of prison confusing. Go back to your alcohol redneck you are more than likely a pig anyway.

    How in the world are you going to use a computer when it uses parts coming from oil –my war was about OIL and disrupting any Cells whom would use drug money to kill people . . . there is nothing perfect about the U.S. Military, but I know a hypocrite when I see one? My enemy is the Police and hypocrites like you. I’ve even talked to a few cops whom have no opinions about Marc and drugs and the drug terror nexus because they couldn’t out argue against my facts and logic due to my bravery of sacrificing myself to protect what few rights we have left because people like you don’t do anything like Marc, Jodie, Me, Barry etc. to save them . . . just watch another movie dude –but don’t you dare watch it from a machine that has any plastic parts (comes from oil which is why half this war is fought) unless you know for a fact those plastic parts all came from plants like hemp etc.

    Dude, your insane rant shows us that being in the US Imperial Army has damaged your brain and heart. You did not fight for me, or Marc, or freedom. What you fought for is US hegemony (look it up in the dictionary), corporate profits, and the military-industrial complex. The US has long invaded small countries such as Vietnam, Iraq and Afghanistan under false pretenses. The USA is all about war, whether it’s a war against people in the Middle East or a war against plants. There are a lot of ticking time-bomb veterans such as yourself who are an example of the karma of loving war, and the lack of mental health counseling delivered by the Veteran’s Administration. Please get help before you go off on somebody in person the way you just spewed here. And try to focus on the real point of this forum, which is that Marc is imprisoned in an illegally-run corporate prison and he has remedies in the courts and the media, as well as via diplomatic channels. What is happening to Marc is a less intense form of the torture and psychological warfare that you and your soldier boys use against people in countries that Uncle Sam invaded under false pretenses. Check out the movie Why We Fight. Get counseling. And get a life.

    You lot think you have problems (which you do) with law enforcement, over here in the uk we have some lunatic fringe makeing a nuisance of themselves preaching the gospel, criminal entrapment, serious organised crime and an economy in free fall, rather like our cousins on your side of the pond.

I’m the reason you even have a job –I’m the reason you had a choice between doing what you do to earn money and not being some STATE selected worker . . . I’m the reason you know how to use a computer. Are you so sick and demented as to have your opinions and yet not deny yourself the luxury of using any form of transportation or plastic (which comes from oil that Americans are also fighting for). If you truly believed that serving in America’s militaries as being ignoble –then I know for a fact that you refuse to work at any job that pays you money and I know you don’t pay your taxes for moral concern –I also know that you ostracize any human in your life whom uses computers or vehicles or whom works or pays taxes (since working in any country that trades with the U.S. –or paying your taxes or using anything that contains plastics goes against your Anti-American military morals) . . .     First of all, anybody who volunteered to serve in the Imperial Army of occupation that is the US military is not too righteous in my opinion. The USA military and all the USA wars including its war against cannabis are part of what’s evil in this world and other than being drafted into the military, if you choose to join Uncle Sam’s army, then you need to say a serious apology to this planet and work for peace. Being a soldier is NOT an honorable job. It’s a war crime job.
    Secondly for Marc and Jodie- Marc is basically a journalist inside a criminally-run organization (private corporate prison) reporting on human rights abuses and other crimes. I urge you to get the ACLu and any other social justice/criminal justice organization, as well as Democracy Now and other real journalists, to expose the private prison corporation, and to sue them for violation of Marc’s civil rights. Go to the World Court in the Hague if you have to, or to federal district court, and sue them for damages. The Canadian government needs to get its consulate involved. And if the Canadian government won’t help, sue them too.
    Marc and Jodie- don’t let the idiot trolls, the prison corporate monsters or anyone else take away your happiness or peace. Whether Marc does the whole time in the US or gets to Canada, you can beat these fools and perhaps dismantle the for-profit prison system in the USA.

If you put a frog in a pot of boiling water –he’ll jump right out, but if you put a frog in a pot of cool or room temp water, while slowly raising the temp, he will boil to death without noticing –that is what is happening to America. I’m currently trying muster up enough educated people that can place lawsuits on the Department of Justice for negligently not deploying U.S. police officers (as many as we have here), judges and DA’s to Mexico, Morocco, France, Spain, Lebanon, Iraq, Iran, Afghanistan, United Kingdom, Germany, Italy, Nigeria, Ivory Coast, Tunisia, Somalia, India, Algeria, S. Africa, Turkey, Russia, France, Greece, Poland, Holland etc so the U.S. military can do their job against an enemy whom makes half their money off of drugs because of the 1961 Singles Convention on Drugs allowed other nations to implement a U.S. friendly drug prohibition laws . . . it’s the drug habits of Asians, Africans, Australians, and Europeans that are the reasons why 2 airplanes were involved in 9/11 (2+2=4) and the deaths of half the Muslim civilians and U.S./Coalition troops in Iraq and Afghanistan . . . if cops can bust drug users and dealers in America –then the law at a time of war states that American cops must bust users and dealers in other nations regardless of jurisdiction –by not doing that –America is at War . . . everybody in the real world recognizes that the Wars in Afghanistan and Iraq were only 3-4 years long when you pretend that drugs were legal (if such wars existed in the first place). Every LA cop knows it’s his or her duty to fly to Scotland and bust heroin users since Scottish users and dealers finance terrorism . . . we must assume that no other nations have police officers and judges since Extremist Muslims are still selling drugs in Europe while killing our soldiers with their drug money. Also, we must sue the police for committing fraud (their unwillingness to not give back at least a third of their pay for an unfinished job since they cannot rid the streets of at least half the crime due to the illicit drug market) . . . also we must sue the Department of Justice for purposefully causing the U.S. to go to war with Extremist Islam (drug money) –it is a well proven (go to any library or ask any lawyer) fact that the police and the rest of the DOJ causes half of the U.S. militaries death, PTSD, injuries and all the other problems we face while at war and after war . . . if the DOJ didn’t cause the War on Terror on purpose –then how do you explain us being overseas in 2007.     Son of Sam Walton, I too did time in the gulf era war 96′-2000, and have some scars, did everything asked to the best of my abilities every day and shaped my life so to live it responsibly-no negative effect on anyone else, then to have the threat of having everything taken away because of cronied,corrupt laws signed off on by disconnected politicians who don’t even consider your feedback as any kind of vote. It’s about freedom utmost-responsibly, get rid of prohibition and get down to the real problem-lack of opportunity/jobs-sucked up by generational wealth with the scraps they throw down fought over by the poor and desperate. Money making, private stock market, human trafficking, penal industry, disgusting. He has helped hundreds of other inmates, and has single-handedly made huge changes to the place — and pressured the prison into making changes through his reports and work inside the prison. Marc is a model prisoner and he’s helping many others. Why should he just shut up and crawl into a hole and die, like you seem to insist he should do? Who would that help? No one. Did you know that most of the marijuana genetics in the USA came from Marc from 1994-2005 because Europe wasn’t sending seeds to the USA? Did you know that the US Marijuana Party and numerous state marijuana parties and law reform organizations were financed by Marc? Did you know that Marc created the first ever online marijuana video website? Did you know that Marc was the ONLY person in the whole world who has devoted millions of dollars to ending prohibition?

    First of all, prison visitors are not allowed to bring anything in, not a hat, sunglasses, purse, or anything at all but one clear plastic baggie with $1 bills for the vending machines. I go through a metal detector and my shoes, coat, everything except what I’m wearing have to go through an x-ray machine — it’s just like airport security. After all that, we’re watched at every angle by cameras in the ceilings, guards hovering around, and mirrored windows that we’re watched through by people we can’t see. There is NO recorded incident of ANYTHING being smuggled in through visits — and in most prisons, over 90% of all incidents of smuggling in contraband are committed by staff employed by the prison.

    Secondly, I guess you’ve never experienced true love and the deepest possible connection with someone that we share. Marc and I cherish any physical contact more than you could ever appreciate. How can you say holding hands is gross? What are you, nine years old? My goodness… you are clearly a bitter, hardened, cynical, lonely man or boy… you don’t know anything about what it’s like to be in our relationship and enjoy the intense passion, adoration, and love we share. I pity you. But I guess you’ll be happy to never, ever be touched by a woman ever again. Or man. Whatever you’re into.

    Hand holding being a sign of weakness ay . . . so your XO in combat told you when you are sleeping –to sleep on your stomach that way if a bomb dropped on you or near you, you could die without suffering –having your spinal chord and nerves all severed to rid pain –let me guess –you think its OK to sleep on one’s back –where a bomb can crush and smash your guts and lungs –causing you to suffocate and suffer a slow and agonizing death –to bleed out within less than a minute where each second (Einstein) feels like a few minutes. Every man when he’s in a war zone or prison wants his hands held by his woman –this brings him close to home and freedom . . . the next time you get deployed to a combat zone –do yourself a favor –hold your woman’s hand until your XO removes the hands . . . and always carry GermX if you worry about people’s hands –but then again –you’d rather hold 100 peoples hands and lick your palms and fingers than to get your torso blown off by an RPG or a vest. Yes, Marc is in Prison –but he’s in a privatized prison that uses no State or Federal guidelines (Lowest Bidder Syndrome) –which means that facility is required by Federal Law (just look it up) to not use U.S. money to pay its taxes or its workers –they in fact must set up other agencies that will give their workers housing, food, clothes etc –to take care of their workers needs –so their workers can do what the company wants out of them –but if such D Ray James workers gets paid in U.S. Cash –then they must apply State or Federal (100%) rules. Also, Federal Law requires the prison to pay for its own expenses via material goods and not cash since they are not allowed to use cash with their own rules . . . but that doesn’t mean they don’t break the laws themselves . . . the DOJ and DOC is by all definition according to the LAW and history of the LAW an illegal sub-section of the U.S. Government that chewed its way into the American Cerebral Cortex like some Thai Cockroach you can find in your ear out in the jungle.

    Yes, he broke US law. While living in Canada. Why should he be subject to US law at all? Would you like to be subject to the weird laws of other countries? Would you like to (for instance) be subject to sharia law? Many muslims think you should. He never came to the US at all, until he was extradited. The real criminals here are the US and Canadian govts. Bottom line: he shouldn’t have to do the time in the US, because he never violated US law in the US.

    It’s true about smuggling, but the guards are pretty watchful, and after visits prisoners get strip-searched. It seems onerous and unnecessary for a “contact visit” to not have any contact.

I’ve spent time in state prison, when I was half your age, and did it like a man.you want to play marc, you have to pay!you really have no idea how bad the world can be.two of my grandparents spent 6 yrs. In nazi concentration camp, and I have to hear you whine about some crap in your food??     Not that I don’t sympathize with Jodie but I’m surprised that prisons EVER let inmates hold hands with outsiders, or have an physical contact at all. Just from a smuggling standpoint, you must admit that holding hands would be a very convenient way to pass something. Do you really need to hold hands? Are you really that immature? Can’t see why Jodie is making such a big fuss over this. Frankly, I don’t let people touch my hands. I don’t know what they may have been scratching last. Talk about creepy and disgusting. Give Marc a break, for crying out loud. He only pretends to like it. Trust me, men don’t really enjoy hand holding as much as women imagine. In fact, we think it makes us look sissy and p-whipped. Can’t talk for Marc, just 99% of the male population.

    Has Marc ever said that they should be living in a country club? No. He points out that “contact visits” are meant to have at least some contact. When a wife visits her husband with their child, and the wife cries because she’s struggling, the husband can’t even reach out to touch her hand – that’s cruel and unnecessary. There’s no reason to deprive visitors from out of the country a simple but essential (for rehabilitation, which is supposed to be the point of prisons and visits) action such as holding hands. Do you really think that rule is justified? You really think that NON-VIOLENT, non-dangerous, didn’t-hurt-anyone people shouldn’t be allowed to comfort their loved ones when they make the long and difficult journey to the prison?

    It may not be a country club but a primary purpose of prison is to help inmates integrate into the general population upon release, and human touch is vital toward that aim.
