A mother with four children is facing eviction because her 17-year-old son was found with a marijuana pipe outside her apartment. Marisa Perez, 34, has lived at the federally subsidized Elena Gardens Apartments in San Jose, California, for 13 years. The housing complex recently enacted a “one strike and you’re out” eviction policy.
Perez had taken her son’s apartment key and sent him to live with his grandmother months earlier, but because his name was still on the lease he is considered a resident by the apartment managers.
In March, the US Supreme Court ruled that the Oakland Housing Authority could evict four elderly tenants because of drug use by their grandchildren and caretakers, even though they were uninvolved and unaware of the drug use.
